Terms & Conditions
The Needed Care Outreach Foundation
These Terms & Conditions apply to donations made to The Needed Care Outreach Foundation and to the use of our donation services.
1. Charitable Purposes
The Needed Care Outreach Foundation works to support children, carers, individuals, and communities in need. Our charitable purposes include the prevention and relief of poverty, the advancement of education, the relief of those in need by reason of age, disability, financial hardship, social disadvantage, or other circumstances, and the advancement of community development and participation.
The Foundation supports people through education, humanitarian assistance, child and carer support, community development, personal development initiatives, volunteering, charitable giving, and other activities that further its charitable objectives.
2. Donations
Donations made to The Needed Care Outreach Foundation are voluntary charitable gifts given to support the Foundation's work and charitable purposes.
By making a donation, the donor confirms that:
- They are legally entitled to make the donation.
- The money or property donated belongs to them, or they have the necessary authority to donate it.
- The donation is not derived from an illegal or unlawful source.
- Any information provided in connection with the donation is accurate and complete.
- Where the donation is made on behalf of another person or organisation, they have the authority to do so.
- Any conditions attached to the donation are clearly communicated to the Foundation before the donation is made.
The Needed Care Outreach Foundation may refuse, decline, or return a donation where required by law, where the donation falls outside the Foundation's charitable purposes, where the donation contains unacceptable or impractical conditions, or where the Trustees determine that accepting or retaining the donation would not be in the best interests of the Foundation or its beneficiaries.
3. Donation Refunds
Donations are generally considered voluntary charitable gifts and are normally final once made. However, The Needed Care Outreach Foundation recognises that genuine mistakes can occur.
Refund requests may be considered where:
- A donation was made in error.
- An incorrect amount was entered.
- A duplicate donation was made.
- A donation was made without the donor's authority.
- The Foundation is legally required to return the donation.
- The donation cannot reasonably be used for the purpose for which it was given.
- The Trustees determine that returning the donation is in the best interests of the Foundation or its beneficiaries.
Refund requests should be submitted as soon as reasonably possible and should include:
- The donor's full name.
- The donation amount.
- The date of the donation.
- The payment method.
- The transaction reference, where available.
- The reason for the refund request.
All refund requests will be considered individually. Refunds are not automatic and will be handled in accordance with applicable law, the Foundation's governing documents, and relevant Foundation policies.
Where a refund is approved, funds will normally be returned using the original payment method.
Where The Needed Care Outreach Foundation is unable to deliver a project according to a donor's specific requirements, the Foundation may contact the donor to seek approval to redirect the donation to another suitable charitable purpose. Where appropriate and legally permissible, the Foundation may instead return the donation.
It is the donor's responsibility to ensure that they understand the purpose and any conditions attached to a donation before making it.
4. Restricted Donations and Appeals
Where a donation is made specifically for an appeal, project, programme, beneficiary group, or particular charitable purpose, The Needed Care Outreach Foundation will seek to use the donation for that purpose in accordance with applicable law and the Foundation's policies.
If more funds are raised than are required, circumstances change, or the Foundation is unable to use the donation exactly as originally intended, the Foundation may seek the donor's approval to redirect the donation to a similar or related charitable purpose.
Where donor approval is not legally required or cannot reasonably be obtained, the Foundation may apply the funds in accordance with applicable law, its governing documents, and its charitable objectives.
5. General and Unrestricted Donations
General or unrestricted donations may be used by The Needed Care Outreach Foundation to support its wider charitable purposes.
This may include funding charitable programmes and projects, supporting beneficiaries, administration, safeguarding, governance, fundraising, volunteer support, communications, and other reasonable costs necessary to operate the Foundation and deliver its charitable objectives.
6. Payment Processing
Online donations may be processed through third-party payment providers. These providers may have their own terms and conditions, privacy policies, processing times, fees, and security procedures.
The Needed Care Outreach Foundation will take reasonable steps to ensure that donation payments are processed securely but cannot be held responsible for technical failures, delays, interruptions, or errors caused by third-party payment providers, banks, card providers, fundraising platforms, telecommunications services, or other external systems.
7. Fundraising Standards
The Needed Care Outreach Foundation is committed to fundraising honestly, respectfully, transparently, and responsibly.
All fundraising activities will be undertaken in accordance with applicable laws, regulations, the Foundation's governing documents, and recognised standards of good fundraising practice.
The Foundation will seek to ensure that its fundraising communications are accurate and do not deliberately mislead donors about the Foundation's activities, beneficiaries, projects, or the use and impact of donations.
8. Use of Donations
The Needed Care Outreach Foundation is committed to using donations responsibly and in accordance with the purpose for which they are given.
Where a donor makes a donation for a specific project or cause, the Foundation will seek to apply the funds to that purpose, including reasonable costs directly connected with delivering the relevant project or service.
Where donations are unrestricted, the Foundation may use them for its wider charitable purposes and for reasonable operational costs necessary to deliver those purposes.
The Foundation will maintain appropriate financial records and will seek to ensure that charitable funds are managed responsibly and in accordance with applicable requirements.
9. Faith-Based and Inclusive Giving
The Needed Care Outreach Foundation welcomes charitable support from individuals, communities, businesses, organisations, and other donors from different backgrounds and beliefs.
Where the Foundation accepts donations designated for a particular faith-based or charitable purpose, such donations will be used in accordance with the donor's stated purpose, applicable law, and the Foundation's charitable objectives.
Where applicable, the Foundation may accept forms of charitable giving including:
- General Donations
- Sadaqah
- Fidya
- Lillah
- Waqf
- Other permissible charitable gifts
Any donation subject to specific religious or charitable requirements will be administered in accordance with those requirements, provided that they are consistent with applicable law and the Foundation's charitable purposes.
10. Donor Information
Donors may be required to provide certain information to enable The Needed Care Outreach Foundation or its payment providers to process donations, issue acknowledgements, comply with legal and regulatory requirements, prevent fraud, and maintain appropriate financial records.
Personal information will be handled in accordance with the Foundation's Privacy Policy and applicable data protection and privacy laws.
11. Gift Aid
Where applicable, donors may be invited to make a Gift Aid declaration.
A donor making a Gift Aid declaration must ensure that they meet the relevant eligibility requirements and that the information they provide is accurate.
The donor is responsible for notifying the relevant tax authority and The Needed Care Outreach Foundation if their circumstances change and they are no longer eligible for Gift Aid.
12. Donor Communications
By making a donation, donors may receive communications relating to their donation, including donation acknowledgements, receipts, administrative correspondence, and information required to process or manage their donation.
Where donors have separately provided consent to receive fundraising or promotional communications, The Needed Care Outreach Foundation may contact them in accordance with applicable data protection and marketing laws.
Donors may withdraw their consent to non-essential communications at any time.
13. Donations of Property or Goods
The Needed Care Outreach Foundation may accept donations of goods, equipment, property, or other non-monetary items where the Trustees consider that accepting such donations is appropriate and consistent with the Foundation's charitable purposes.
The Foundation may decline donations where the items are unsuitable, unsafe, impractical to store or transport, subject to unacceptable conditions, or likely to create disproportionate costs or liabilities.
Ownership of donated goods or property will transfer to the Foundation in accordance with the terms agreed at the time of donation.
14. Acceptance of Donations
The Trustees of The Needed Care Outreach Foundation reserve the right to decline or return donations where accepting or retaining the donation could:
- Contravene applicable law or regulation.
- Conflict with the Foundation's charitable purposes.
- Create unreasonable financial, legal, reputational, or operational risks.
- Place inappropriate restrictions on the Foundation.
- Cause harm to beneficiaries or other persons.
- Otherwise be contrary to the best interests of the Foundation.
The Foundation may carry out appropriate due diligence in relation to donations where necessary.
15. Changes to These Terms & Conditions
The Needed Care Outreach Foundation may update these Terms & Conditions from time to time to reflect changes in legislation, regulatory requirements, Foundation policies, or charitable activities.
The latest version published by the Foundation will apply to donations made after the date on which the updated Terms & Conditions take effect.
16. Governing Law
These Terms & Conditions shall be interpreted and applied in accordance with the laws applicable to The Needed Care Outreach Foundation and its place of registration.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or protections that donors may have under applicable law.
